Terms of use

These Terms of Use (“Terms”) govern access to and use of the SOY TULUM platform (the “Platform”), available at https://soytulum.com.

The Platform is operated by DOTSOA OOD, a company incorporated under the laws of Bulgaria, with registered address at bul. Tsarigradsko shose No 115M, European Trade Center, Building D, et. 1, Sofia, Bulgaria (“Company”, “we”, “us”, or “our”).

By accessing or using the Platform, you agree to be bound by these Terms. If you do not agree, you must not use the Platform.

1. Nature of the Service

SOY TULUM is an online local discovery platform for Tulum, Mexico. It helps customers discover independent local businesses, freelancers, and service providers (“Providers”) — the people who cook, create, repair, teach, grow and care for the community — and connect with them directly.

The Platform lets you browse local profiles, see what Providers offer — including services, photos, neighborhoods, prices, and hours where available — and reach them directly via WhatsApp, phone, or their own links.

SOY TULUM is a discovery service only. We are not a party to any agreement, booking, quote, or transaction between you and a Provider. We do not perform, supervise, endorse, or guarantee any services delivered by Providers, and we do not charge commissions on work agreed between you and a Provider.

Providers are independent third parties solely responsible for their own pricing, availability, licensing, insurance, quality of work, and conduct. Any profile or contact information is provided for convenience and may be incomplete or outdated.

2. Accounts and Profile Claims

Browsing the Platform is free and does not require an account.

Providers may create or claim a free profile. By creating or claiming a profile you confirm that:

  • you are authorized to represent the business or offer the services listed;
  • the information you provide is accurate and kept up to date;
  • you have the right to use any photos, names, or content you upload.

We may ask you to verify a claim (for example, with a one-time code) and may edit, suspend, or remove profiles that are inaccurate, misleading, unlawful, or in breach of these Terms.

You are responsible for maintaining the confidentiality of your account credentials and all activity performed under your account.

3. Permitted Use

You may use the Platform for lawful purposes only.

You agree not to:

  • use the Platform for illegal, deceptive, or fraudulent activities;
  • attempt to reverse-engineer, scrape, or systematically extract profiles or Platform content at scale;
  • interfere with the security, availability, or integrity of the Platform;
  • contact Providers for spam, solicitation, or any purpose unrelated to their services;
  • use the Platform to build or operate a competing service.

We reserve the right to restrict, suspend, or terminate access for violations of these Terms.

4. Free Service and Fees

Browsing profiles and contacting Providers through the Platform is free. Creating and claiming a Provider profile is free.

Any fees, deposits, quotes, or charges for the services themselves are set and collected by the Provider and agreed directly between you and that Provider. SOY TULUM does not process payments for Provider services and is not responsible for them.

If we introduce optional paid features in the future, any applicable charges and limits will be displayed before they apply and take effect prospectively.

5. Use of Profiles and Content

Provider profiles, contact details, and other content on the Platform are provided to help you find and contact a Provider for your own use.

You may not:

  • harvest, resell, sublicense, or redistribute profiles or Platform content as a standalone or competing service;
  • present Platform content as originating from another platform or service.

If you submit information to the Platform — for example, as a Provider, your business and service details — you confirm it is accurate and that you have the right to share it, and you grant us a non-exclusive license to host and display it for the operation of the Platform.

6. Accuracy and No Warranty

While we aim for accuracy:

  • profiles, prices, hours, and other Provider details may be incomplete, outdated, or inaccurate;
  • availability and pricing are determined by Providers and may change without notice;
  • parts of the Platform may display clearly labeled sample content while local onboarding is in progress.

The Platform is provided “as is” and “as available”, without warranties of any kind, including accuracy, completeness, reliability, fitness for a particular purpose, or non-infringement.

You are solely responsible for verifying Provider details and confirming services directly with the Provider before relying on them.

7. No Professional Advice

The Platform does not provide legal, financial, investment, medical, regulatory, or compliance advice.

All information is provided for general informational purposes only and must not be relied upon as professional advice.

8. Intellectual Property

All intellectual property rights related to the Platform software, system architecture, user interface, branding, and design are owned by or licensed to DOTSOA OOD.

You are granted a non-exclusive, non-transferable, revocable right to access and use the Platform in accordance with these Terms.

9. Third-Party Providers and Links

The Platform references independent Providers and may link to third-party websites, messaging apps (such as WhatsApp), or services.

We do not control, endorse, or guarantee any Provider, third-party content, or the services they offer. Contact via WhatsApp, phone, or external links happens outside the Platform and is governed by those services’ own terms.

Any dealings with, or reliance on, a Provider or third-party content are solely at your own risk.

10. Limitation of Liability

To the maximum extent permitted by law:

  • DOTSOA OOD shall not be liable for any indirect, incidental, consequential, or special damages, including loss of profits, data, or business opportunities.
  • We are not responsible for the acts, omissions, pricing, quality, or conduct of any Provider, or for any agreement or transaction between you and a Provider.
  • Our total liability for any claim shall not exceed the amount, if any, paid by you to us in the three (3) months preceding the event giving rise to the claim.

11. Indemnification

You agree to indemnify and hold harmless DOTSOA OOD from any claims, damages, losses, or expenses arising from:

  • your use of the Platform,
  • your dealings or transactions with any Provider,
  • your violation of these Terms.

12. Suspension and Termination

We may suspend or terminate access to the Platform at any time if:

  • you violate these Terms,
  • required by law,
  • necessary to protect the Platform or other users.

Termination does not affect accrued payment obligations.

13. Changes to the Terms

We may update these Terms from time to time.

Continued use of the Platform after changes take effect constitutes acceptance of the revised Terms.

14. Governing Law and Jurisdiction

These Terms are governed by the laws of Bulgaria, without regard to conflict-of-law principles.

All disputes shall be subject to the exclusive jurisdiction of the competent courts in Sofia, Bulgaria.
